Dispute Resolution

Your feedback is important to us. You understand and agree that you will contact us immediately if you have any concerns so that we can discuss a mutually acceptable solution.

If we are unable to resolve a dispute by negotiation and discussion within 14 days, you agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not able to meet conveniently in person.

The mediator is to be appointed by agreement with you, or failing agreement within 21 days of the negotiation period ending, we will seek the appointment of a dispute resolution profession by the Queensland Small Business Commissioner or similar neutral authority.

You agree to share all the costs of mediation equally with us.

No legal action may be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted, except where urgent interlocutory relief such as an injunction is required.

You irrevocably agree that if an agreement is not reached under the dispute resolution procedures above, the courts of Queensland, and the Commonwealth of Australia, will have exclusive jurisdiction.

Confidentiality is very important to preserve the reputation of your business and ours. At no time will any communications or discussions in relation to any dispute be made public. This includes but is not limited to any social media platforms. Any negative public discussion or comments about either party will be considered defamatory, negative, or otherwise damaging, and may be the subject of compensation in any mediation or litigation claim.
